Apple was granted a deadline today to make changes to the App Store following the massive antitrust lawsuit with Epic Games that was settled earlier this year. Now he won’t have to make those changes by December 9, and it’s unclear at this time whether he’ll have to make them.
The Apple vs Epic case was settled by a decision of Judge Yvonne Gonzalez Rogers earlier this year. The long and short of the decision is that Apple must allow third-party payment options on the App Store and must make the necessary changes by December 9 of this year. As one can imagine, Apple was not satisfied with this result and asked Judge Rogers for a delay. Judge Rogers denied. Apple has also appealed its decision. Now, just hours before the new payment options went live in the App Store, Apple has been granted a stay.
The Ninth Circuit Court of Appeals ruled on the delay. He said Apple would not have to make the changes to the App Store until the appeal is resolved. “Apple has also demonstrated sufficient irreparable damage,” the ruling reads. âTherefore, we grant Apple’s motion to stay part (i) of subsection (1) of the permanent injunction. The suspension will remain in effect until the warrant is issued in this appeal. “
Depending on the length of the call, it may take months or even years for Apple to need to make changes to the App Store, if at all. The court ruling implies that it may be open to overturning the original ruling: “Apple has demonstrated, at a minimum, that its appeal raises serious questions about the merits of the district court ruling that Epic Games, Inc. has not shown that Apple’s conduct violates any antitrust laws, but has shown that the same behavior violates California’s Unfair Competition Law.
